Freehold vs leasehold in Bali for a foreign buyer: PT PMA holds HGB for up to 80 years, leasehold runs 25 to 30 years per term with negotiated extension.

For a foreign buyer in Bali, freehold and leasehold are not what they would be in the US or the UAE. Indonesian law reserves freehold, called Hak Milik, for Indonesian citizens only under Article 21(1) of the 1960 Basic Agrarian Law, so a foreign individual cannot hold it. The two routes that actually work for a foreign buyer are a PT PMA, an Indonesian company you own that holds Hak Guna Bangunan (HGB) on the land, and leasehold (Hak Sewa), where you hold the right to use a property for a fixed term.

The PT PMA freehold route gives the strongest claim a foreigner can hold in Bali. Under Government Regulation 18 of 2021, HGB is granted for an initial 30 years, extendable for 20 years, then renewable for another 30 years, for up to 80 years. The asset belongs to the company, so on exit you can transfer the property out of the PT PMA or sell the company shares. Setup is heavier: BKPM Regulation 5 of 2025 lowered the minimum paid-up capital to IDR 2.5 billion, around 150,000 USD, with a 10 billion IDR total investment plan per business code still required.

Leasehold is the simpler entry. Any foreigner can sign a Hak Sewa without an Indonesian residence permit and without forming a company. Bali leases commonly run 25 to 30 years per agreement, and an extension clause is usually negotiated up front to push the effective term toward 70 to 80 years. There is no statutory cap on lease length in Indonesian law, but many notaries decline to draft a single-term lease beyond 30 years.
