Leasehold: A leasehold right can pass to heirs for the remaining contract term, but only if the original agreement contains an explicit assignability-on-death clause. Hak Pakai: Hak Pakai can transfer to a foreign heir only if the heir is legally resident in Indonesia with a valid KITAS or KITAP stay permit. A non-resident foreign heir who inherits Hak Pakai must sell or transfer the title within one year under the Basic Agrarian Law (UUPA Law No. 5 of 1960), or it reverts to the state.
On tax: inheritance of property is exempt from Indonesian income tax under PPh Law No. 36 of 2008, Article 4(3)(a), and PMK 81/2024 confirms that land or building transfers caused by death are not subject to final income tax. If an actual land or building title transfers to an heir (as opposed to PT PMA shares), BPHTB applies at 5% of the taxable value above IDR 300 million, a more favorable threshold than a regular purchase.
